Rental Terms and Conditions of Spielkistl
- httpsThe rental of play equipment is only available to non-commercial organisers within the district of Ebersberg (associations, organisations or private individuals) and employees of the District Office of Ebersberg (hereinafter referred to as the “Customer”). Subject to availability, bookings by customers resident outside the district may be made one week prior to the desired rental start date.
- There is no legal entitlement to rent the equipment. The rental contract is concluded upon the landlord sending the invoice to the customer.
- The prices published on the website on the booking date shall apply. This also applies to consumable materials.
- Liability independent of fault for initial defects of the rental item pursuant to Section 536a (1), sentence 1, case 1 of the German Civil Code (BGB) is excluded.
- The landlord (District of Ebersberg), insofar as legally permissible, assumes no liability for personal injury or property damage arising from or in connection with the rental of the play equipment. This means that the landlord is only liable:

- a. for intent and gross negligence
- b. in the case of slight negligence, for damages resulting from injury to life, body or health
- c. in the case of slightly negligent breach of essential contractual obligations, limited to the foreseeable, typical damage at the time of contract conclusion
- This limitation of liability also applies in favour of the landlord’s vicarious agents.
- The customer is obliged to use the play equipment properly, ensure supervision by an adult and handle the equipment with care. Upon rental, the customer assumes the duty to ensure traffic safety for the equipment. It is expressly noted that appropriate protective clothing must be worn when using the play equipment.
- The customer is obliged to compensate for any damage caused by them to the play equipment in the amount of the incurred repair costs. If repair is impossible due to destruction or loss of the equipment, the customer must compensate the landlord for the replacement value. The landlord will issue an invoice, which must be paid within 14 days.
- Subletting of the play equipment by the customer is not permitted.
- The customer is responsible for the timely collection and return of the play equipment.
- The play equipment must be collected on the booking day at 9:30 a.m. from the warehouse at Anzingerstraße 10a, Ebersberg.
- The return must take place at 8:00 a.m. on the working day following the last booking day, or on Friday if the equipment was rented outside the Whitsun and summer holidays between Monday and Thursday.
- The above times are fixed and must be adhered to strictly. Exceptions or alternative collection times cannot be agreed by telephone or email. In the event of late return, a late fee equal to the price published on the booking date, any loss-of-rental damages or other compensation claims will be charged to the customer.
- Damage must be reported immediately and without request at least in text form (i.e. by email to spielkistl@lra-ebe.de).
- The play equipment must be folded and packed exactly according to instructions and returned dry and clean. This applies in particular to bouncy castles, which when folded must not exceed the dimensions of a Euro pallet (0.8 × 1.2 m). The landlord reserves the right to charge an additional fee of EUR 20.00 for increased effort in the event of non-compliance.
- If additional parts (e.g. tension straps) are missing upon return, the costs for replacement (if applicable less a “new for old” deduction) will be charged.
- The customer is responsible for the proper and traffic-safe transport as well as correct assembly and disassembly of the play equipment.
- The landlord reserves the right to charge a cleaning fee of EUR 30.00 per play equipment in the event of soiling.
- The play equipment “Hamster Wheel” must not be dismantled.
- No deposit is required. Please note that bookings are therefore only possible with full name and address. The landlord reserves the right to verify this by requesting identification documents.
- Bookings are generally made via the website https://spielkistl.de. In justified exceptional cases, bookings on account may be possible. Please contact spielkistl@lra-ebe.de for this purpose. The decision lies solely with the landlord.
- The customer automatically receives a booking confirmation and invoice by email. The invoice must be paid before collection of the booked play equipment. Otherwise, the equipment will not be handed over.
- The customer is obliged to carry the booking confirmation, digitally or printed, when collecting and returning the play equipment.
- Cancellations by the customer are not possible and can only be made by the landlord. This applies in particular in the event of bad weather for bouncy castles and comparable play equipment. In justified exceptional cases, customers may request a free cancellation by email to spielkistl@lra-ebe.de. It is explicitly noted that poor weather conditions outside the aforementioned play equipment do not justify a free cancellation.
